What Are Car Accident Settlements?

If you are unlucky enough to be in a car accident, one way that you can recuperate the money that you’re owed for damages is to reach a settlement with the insurance company out of court.  Essentially in a settlement the parties involved, usually you and the insurance company, reach an agreement on the car crash compensation amounts that you are owed.  Then you sign a piece of paper that waives all your rights to any further legal actions resulting from the accident at hand.

There are numerous amounts that you are entitled to under a settlement.  You of course are entitled to get money resulting from any damages to your car or personal injuries sustained as a direct result of the accident.  But you can also be entitled to be compensated for any time off work, any expenses that you incurred to get rental cars because your car was in the shop, and also money to cover any ongoing treatments that you might have as a result of the accident.  You can also be entitled to an amount called “pain and suffering.”  The goal of pain and suffering damages is to compensate you for any loss in the quality of your life that resulted from the accident.  This amount can be difficult to ascertain, so if you are entitled to a large amount of pain and suffering, you should almost always consult an attorney.

Most auto accidents will have a period where both sides will try to reach a settlement because it is in their best interests to do so.  However, if the two sides can’t come to an agreement, the case then progresses from a settlement case to a court case.  This involves hefty legal fees for both parties, so if you can settle out of court it is advisable for you to do so except in extraordinary circumstances.
